Mediation & Arbitration

Resolving disputes outside the courtroom — as counsel to a party, and as the neutral appointed to decide or to mediate.

The firm acts in two capacities. It represents parties in arbitration and in mediation, and its lawyers serve as mediator and as arbitrator where the parties appoint them.

Daniel B. Schwartz is a certified mediator and has drawn up hundreds of mediation agreements across commercial and family matters. That experience informs how the firm advises parties considering these routes: candidly, including when they are the wrong choice.

Arbitration is not automatically faster or cheaper than court. It is more private, more final, and it is what the parties agreed to.

What we handle

As counsel
Representation in commercial and civil arbitration, from the appointment of the tribunal through to the award and any challenge to it.
As neutral
Service as arbitrator and as mediator in commercial disputes, and in family and personal status matters.
Agreements
Drafting arbitration and mediation clauses, and the settlement agreements that conclude a mediation.
Cross-border
Arbitration where the parties, the seat or the governing law sit in different countries.

How we work

  • A clear view of whether mediation, arbitration or litigation actually suits the dispute.
  • Settlement agreements drafted so they are enforceable, not merely signed.
  • Where the firm sits as neutral, it does not act for either party in the same matter.
